Fare convergere in Switchub queste esperienze professionali produrrà un incubatore di professionisti e informazioni, in cui, ovunque tu sia e in qualsiasi momento, potrai attingere e smistare per favorire la crescita dell’intera forza lavoro globale.
Dal direttore di produzione fino al tecnico video fino anche al cameraman che può realizzare il tuo spot aziendale o al noleggio dell’attrezzatura, cerca tra la community per trovare quelli che meglio si adattano alle tue esigenze di lavoro. Pro’s Directory: professionisti disponibili per un ingaggio di lavoro ed aziende in continua ricerca di personale, entrambi con il desiderio di collegarsi in modo semplice, immediato e sicuro.
Problem Solving: professionisti alla ricerca di risposte legate alla propria professione e al proprio lavoro, dal problema tecnologico fino al semplice alloggio per la produzione, chiedi consigli alla community.
La prima categoria consente al datore di lavoro, tramite la funzionalità “booking”, di ricercare e prenotare il professionista, compilando semplicemente la finestra infobox in cui bisogna indicare la città, la date del possibile lavoro e la mansione il sistema avvia il primo matching dopo aver cliccato su “cerca”. La selezione del personale è automatica, dopo aver inserito le informazioni necessarie, il sistema di ricerca booking propone i professionisti più idonei al tuo progetto in base alla città, disponibilità e mansione indicata dal professionista nel proprio account. Inoltre, qualora si voglia ottimizzare la selezione del personale, il sistema dispone di ulteriori filtri di ricerca avanzata indicando il compenso, le soft e hard skills il datore di lavoro usufruirà di una lista dettagliata e selezionata con professionisti idonei alle sue esigenze di lavoro.
Infine, la piattaforma presenta una sezione dedicata al “problem solving”, che permette la risoluzione dei problemi attraverso la condivisione delle esperienze degli utenti della community.

In base ai tuoi bisogni iscriviti come professionista oppure come azienda, crea il tuo account personale o aziendale e inizia a navigare. Il portale dispone di una chat interna per le varie comunicazioni e una sezione di archivio privato che memorizza i lavori ottenuti e conclusi. Avrai un rendiconto delle giornate lavorate, con la somma del compenso che dovrai avere o dare.
1.CONDIZIONI GENERALI
Si prega di leggere attentamente questa sezione. Accedendo al portale web Switchub (“Sito”) si accettano i termini e condizioni di seguito definiti.
Le presenti Condizioni d’Accordo (“Accordo”) stabiliscono i termini legalmente vincolanti relativi all’utilizzo dei servizi di Switchub (“Servizi”). Utilizzando i Servizi, l’utente accetta di essere vincolato dal presente accordo in qualità di utente registrato. Il termine “utente” o “utenti” si riferisce ad entrambe le modalità di registrazione esistenti nel portale Switchub che sono due categorie di account; Azienda (Compagnia) e Professionista, definiti entrambi (“Membri”). Ciascuno può considerarsi autorizzato ad utilizzare i Servizi una volta impegnato a rispettare tutte le norme del presente accordo.
La Piattaforma Switchub offre un luogo online (“Hub”) che consente agli utenti di cercare e prenotare un Professionista, di offrire un ingaggio di lavoro, di offrire la propria professionalità, pubblicare contenuti che descrivono la propria professione e contenuti legati al mondo del lavoro, di aumentare e migliorare le proprie capacità professionali. L’utente che cerca, prenota e offre lavoro è l’Azienda/Compagnia mentre l’utente che offre la propria professionalità è il Professionista. Entrambe le categorie pubblicano contenuti che descrivono la propria professione e contenuti legati al mondo del lavoro.
Devi registrare un account per utilizzare le funzioni della Piattaforma Switchub e mantenere accurate le informazioni del tuo account. In qualità di fornitore della Piattaforma Switchub, Switchub non possiede, controlla, offre né gestisce alcuna proposta di ingaggio lavorativo. Switchub non è una parte contraente dei contratti stipulati direttamente tra Azienda (“Compagnia”) e il Professionista né un’agenzia interinale né un venditore dei Servizi offerti. Switchub non agisce in qualità di agente per nessun degli utenti registrati. L’utilizzo dei Servizi di Switchub sono a titolo gratuito.
Prima di utilizzare il sito, è necessario leggere l’intero Accordo, le politiche del Sito e tutte le informazioni collegate. È necessario leggere e accettare i Termini e Condizioni per utilizzare i servizi. Accettando il presente Accordo per l’utente, mentre accedi al nostro Sito, accetti che il presente Accordo si applichi ogni volta che utilizzi il Sito o quando utilizzi gli strumenti che mettiamo a disposizione per interagire con il Sito.
Il presente Accordo rimarrà in vigore a tutti gli effetti per tutto il tempo d’utilizzo del servizio e di adesione al Sito stesso. Si può terminare l’iscrizione in qualsiasi momento, per qualsiasi motivo, seguendo le istruzioni sul Sito. Switchub ha il diritto di porre termine a qualsivoglia adesione in qualsiasi momento, senza preavviso, temporaneamente o in via definitiva, qualora l’utente utilizzi in modo illecito i servizi o non rispetti i termini e condizioni del presente accordo. Sarà inviata, tramite email, comunicazione e relativa motivazione dal momento in cui la limitazione prende effetto.
Switchub si riserva il diritto, a sua completa discrezione, di apportare modifiche a qualsiasi parte del Sito. In ragione della sua politica di aggiornare e migliorare il Sito, Switchub potrebbe desiderare di modificare questi Termini e Condizioni (incluse quelle relative all’utilizzo dei Servizi e dei Contenuti). Le modifiche contrattuali disposte da Switchub saranno comunicate agli utenti attraverso pubblicazione sul portale o tramite indirizzo email e l’utente avrà 30 giorni per recedere gratuitamente, senza alcuna penalità e senza specificare la motivazione; qualora invece trascorrano i 30 giorni senza esercitare il recesso, la nuova clausola/modifica contrattuale si intenderà accettata.
Switchub è un progetto con una piattaforma online in versione beta, per tale motivi potrebbero cessare le funzionalità e accessi ai servizi, temporaneamente o in vie definitive nel caso in cui ci siano :
– improvvisi problemi tecnici, informatici e amministrativi,
– trasferimenti della piattaforma in altri domini o applicativi per aggiornamenti o migliorie,
– aggiornamenti del sistema tecnico informatico,
– assenze di attività degli utenti o assenza di registrazioni,
– difficoltà economica riguardanti la gestione tecnico informatica e amministrativa.
Gli utenti saranno informati almeno 15 giorni prima, tramite email o canali ufficiali di Switchub se la cessazione dei servizi è prevedibile, entro le 48 ore dopo l’accaduto se la cessazione è imprevista.
2.Servizi
- I Servizi sono forniti così come sono e come disponibili all’utente. Switchub non può garantire e non promette alcun risultato specifico dall’utilizzo dei Servizi stessi.
- I Servizi sono per l’uso personale dell’utente registrato al Sito e non possono essere utilizzati in relazione a qualsivoglia finalità commerciale, ad eccezione di quelle specificamente avallate o approvate da Switchub. Usi illeciti e/o non autorizzati dei Servizi, compresa la raccolta di username e/o indirizzi e-mail e/o dati personali degli utenti con mezzi elettronici o altri al fine di invio di e-mail non richieste, sono vietati.
I Servizi che l’utente può utilizzare con le funzionalità di Switchub sono :
- La costruzione online del proprio profilo professionale.
- Procacciare nuovi contatti professionali.
- La prenotazione del professionista per nuove e future prestazioni lavorative.
- Porre a disposizione la propria professionalità.
- Pianificazione calendario della propria disponibilità.
- Archivio personale dei lavori svolti e riepilogo dei compensi da inviare o ricevere.
- Social Media dedicato agli argomenti professionali e a tutto ciò che lega le dinamiche del lavoro.
- Un database di figure professionali.
- Aumentare e migliorare la propria capacità professionale.
- Switchub si riserva il diritto di cancellare o bloccare temporaneamente, senza preavviso, l’utente che ha utilizzato in modo illecito i servizi del Sito. L’utente riceverà informazioni, tramite email, sulle motivazioni che hanno portato l’eventuale blocco di accesso.
- I servizi possono essere ampliati o modificati a secondo dell’esigenza che individua Switchub.
- Per poter utilizzare i servizi di Switchub bisogna registrare un account tramite una email e password personale, le informazioni saranno utilizzate per eventuale ripristino della password stessa e per consentire l’accessibilità e l’utilizzo dei servizi nel portale web.
- L’email utilizzata per la registrazione permetterà anche di ricevere informazioni ufficiali di Switchub. L’email dell’utente non verrà ceduta a terzi per attività pubblicitarie o per altro che non riguardino le attività e i servizi di Switchub.
Ci sono due categorie di adesione al Sito, come descritto di seguito. Switchub si riserva il diritto di ampliare o modificare queste categorie a sua unica discrezione. Accedendo a Switchub tutti gli utenti concordano con questi termini; gli utenti verranno comunque avvisati, e verrà data possibilità di recedere dal servizio entro 30 giorni diversamente le modifiche si intendono accettate.
- Registrazione azienda (I’m a company)
Ferma restante l’accettazione di questo documento e dei termini generali qui enunciati, è concesso alle compagnie l’accesso alle informazioni contenute nel nostro database. Ogni azienda deve garantire la propria buona fede ed utilizzare il Sito in quanto tale.
Le compagnie devono utilizzare le informazioni presenti nel database del Sito per il solo scopo di considerare un’eventuale assunzione o collaborazione con i nostri utenti.
Switchub non fornisce alcuna garanzia di veridicità in relazione alle informazioni fornite dagli utenti sul nostro database e perciò non possiamo assumere alcuna responsabilità per quanto riguarda l’uso che ne venga o meno fatto. Tutti i termini, condizioni, garanzie e dichiarazioni, espressi o impliciti, incluse le condizioni di commerciabilità o idoneità manifestate dagli utenti sono di loro personale responsabilità.
Switchub non può, in nessun caso, essere ritenuta responsabile di eventuali danni indiretti, speciali o consequenziali, derivanti in qualsiasi modo dagli utenti Professionisti.
- Registrazione professionista (I’m a professionist)
Ogni utente ha il diritto di inserire, in forma prescritta e in forma autonoma, le informazioni del proprio profilo (“Informazioni”) in una pagina web del nostro portale Switchub (“Sito”). L’utente ha il diritto di utilizzare i servizi di Switchub che sono rilasciati in forma gratuita e disponibili 24 ore su 24. Nel caso in cui ciò non fosse possibile, qualsiasi problema verrà ad ogni modo risolto nel più breve tempo ragionevolmente possibile.
Con il tuo esplicito consenso, per le sessioni che tu determinerai, renderemo automaticamente i dati forniti disponibili agli altri utenti del nostro Sito, compresi gli utenti Azienda.
I dati che gli utenti rendono visibile nel portale devono essere di natura idonea per la sola finalità richiesta per l’utilizzo dei servizi, Switchub non richiede di divulgare nel portale in forma pubblica o in forma privata dati sensibili come: origine razziale ed etnica; convinzioni religiose, filosofiche o di altro genere; opinioni politiche; adesione a partiti, sindacati, associazioni od organizzazioni a carattere religioso, filosofico, politico o sindacale; stato di salute, la vita sessuale, l’orientamento sessuale.Ogni tipo di divulgazione dei dati sensibili e di sola responsabilità dell’utente, Switchub invita gli utenti a segnalare immediatamente eventuali irregolarità del caso.
Switchub non è in grado di verificare o fornire alcuna assicurazione riguardante la natura o la durata di qualsiasi lavoro o appuntamento offerto come conseguenza dell’utilizzo del Servizio. Resta l’esclusiva responsabilità dell’utente di assicurarsi che qualsiasi cosa offerta sia accettabile o meno. Tutta la corrispondenza elettronica inviata all’indirizzo e-mail dell’utente registrato al Servizio è destinato alla sola persona in questione, come unico destinatario. L’account è a rischio se si inoltrano delle e-mail che contengono link rilevanti connessi al proprio profilo individuale.
Switchub non può, in nessun caso, essere ritenuta responsabile di eventuali danni indiretti, speciali o consequenziali, derivanti in qualsiasi modo dagli utenti Azienda.
3.Contenuti
A nessun utente (azienda o professionista) registrato è concesso di caricare, distribuire o disseminare nel Sito qualsiasi informazione che sia calunniosa, diffamatoria, oscena, pornografica, offensiva, che, in ogni altro modo, violi qualunque legge o i diritti di qualsiasi altra persona o entità, o che contenga una sollecitazione di fondi, beni e servizi o pubblicità.
Switchub non intende assumere alcuna responsabilità se tali regole non siano rispettate. L’utente è responsabile personalmente dei contenuti divulgati nel sito.
Switchub, a sua sola discrezione, si riserva il diritto di rigettare, rifiutare di postare o rimuovere qualsiasi post, inclusi i messaggi privati, scritti da qualsiasi utente o di restringere, sospendere o annullare l’accesso a tutto o precise parti del servizio in qualsiasi momento, per qualsiasi o per nessuna ragione specifica, con o senza notifica, ma di certo senza assumersi alcuna responsabilità.
Usando i Servizi, l’utente garantisce che tutte le informazioni registrate sono veritiere ed accurate. È sempre l’utente a dover garantire il mantenimento e la cura delle stesse, un’età superiore ai 18 anni ed un uso del servizio coerente e secondo legge.
“Età minima” significa 16 anni. Tuttavia, se la legge richiede che tu debba avere un’età maggiore affinché Switchub possa legalmente fornire i Servizi senza il consenso parentale (incluso l’utilizzo dei Suoi dati personali), allora l’Età minima sarà quella stabilita dalla legge.
Quando un utente si registra sul Sito, gli viene chiesto di scegliere una password. Questi è il solo responsabile per qualsiasi uso della propria password e del proprio account. L’utente si impegnano a non utilizzare account, username e password di terze parti e a non rivelare i propri dati di accesso a parti terze. L’utente si impegnano inoltre a notificare immediatamente a Switchub qualsiasi sospetto di uso non autorizzato del proprio account o di accesso alla propria password.
I Servizi sono intesi esclusivamente per uso personale e non possono essere usati per uso commerciale se non sono precedentemente approvati da Switchub. Usi illegali e/o non autorizzati dei Servizi, incluso il tentativo di raccogliere username e password degli utenti con mezzi elettronici o di altro tipo per l’invio di mail non richieste è vietata.
Switchub non reclama alcun diritto di proprietà di testi, file, immagini, foto, video, suoni, opere musicali, opere d’autore, o altri materiali e informazioni dell’utente (“Contenuti”) che sono postati sul sito. Dopo la pubblicazione del contenuto, l’utente continua a mantenere tutti i diritti di proprietà sul contenuto e continua ad avere il diritto di utilizzare il contenuto stesso in qualsiasi modo ritenga lecito. Pubblicando i Contenuti su o attraverso il Sito, l’utente concede a Switchub di utilizzare, modificare, eseguire pubblicamente, visualizzare pubblicamente, riprodurre e distribuire tali Contenuti su e attraverso il Sito o sui canali di divulgazione promozionale legati a Switchub, non modificheremo il significato della Sua espressione. L’utente è libero di concedere in licenza i propri Contenuti a chiunque altro in aggiunta a Switchub.
Switchub non è tenuto a pagare per l’utilizzo dei contenuti presenti sul Sito.
I Contenuti sul Sito possono comprendere informazioni generali su questioni legali, finanziarie, sanitarie e di altro tipo. Le informazioni divulgate dall’utente sono di loro personale responsabilità, la veridicità e idoneità di esse non sono di responsabilità di Switchub è obbligo dell’utente accertarsi prima di una qualsivoglia azione e accettazione dei Contenuti.
Forniamo accesso non monitorato a Contenuti di terze parti, inclusi feedback degli utenti e articoli con Contenuti e opinioni originali (o collegamenti a tali contenuti di terze parti). Agiamo solo come un portale e non abbiamo alcuna responsabilità basata o correlata ai contenuti di terze parti sul Sito, derivanti dalle leggi sul copyright o da altre proprietà intellettuali, diffamazione, privacy.
Il Sito può contenere collegamenti ad altri siti Web di terzi. Non controlliamo i siti Web a cui ci colleghiamo dal Sito. Non approviamo i contenuti, i prodotti, i servizi, le pratiche, le politiche o le prestazioni dei siti Web a cui ci colleghiamo dal Sito. L’uso di contenuti di terze parti, collegamenti a contenuti di terze parti e/o siti Web è a tuo rischio.
E’ possibile cancellare il proprio account in ogni momento, accedendo alle impostazioni del proprio profilo. La cancellazione causerà la rimozione permanente di tutti i dati da te forniti, inclusi i dati generati dall’utilizzo del sito. Il processo non è reversibile.
- L’utente garantisce che:
è il proprietario dei Contenuti pubblicati su o tramite i Servizi o, comunque, di avere il diritto di concedere la licenza d’uso stabilita in questa sezione.
Non collabora o è proprietario di una piattaforma web che abbia le stesse finalità e/o servizi proposti da Switchub, se verrà accertato un utilizzo di Switchub per riprodurre copia dei servizi presenti o per recare danno al portale stesso e agli utenti iscritti, ogni condotta illecita e controversia di questo aspetto sarà disciplinata in via legali.
La pubblicazione dei Contenuti su o attraverso il Sito non viola il diritto alla privacy, diritti pubblicitari, diritti d’autore, diritti contrattuali o altri diritti di qualsiasi persona.
Accetta di pagare per tutte le royalties, le tasse e altre somme di denaro dovute a qualsiasi altra persona in ragione di qualsiasi contenuto pubblicato dall’utente tramite i Servizi.
Switchub non si assume alcuna responsabilità per i Contenuti pubblicati dagli utenti. Ciononostante, Switchub potrà eliminare qualsiasi Contenuto che a esclusivo giudizio di Switchub viola il presente Accordo o che possa risultare offensivo, illegale o violare i diritti, danneggiare o minacciare la sicurezza di qualsiasi persona e quella del sito. Switchub non ha l’obbligo di modificare o rimuovere i Contenuti inappropriati, e nessuna responsabilità per la condotta dell’utente che presenta tale Contenuto.
Fatta eccezione per il Contenuto pubblicato dall’utente, l’utente stesso non può copiare, modificare, tradurre, pubblicare, trasmettere, distribuire, eseguire o vendere qualsiasi altro Contenuto visualizzato o pubblicato mediante i Servizi di Switchub.
- L’utente dichiara che:
non violerà né si appropria indebitamente di alcun diritto d’autore, brevetto, marchio, segreto commerciale o altro diritto di proprietà intellettuale o diritto di proprietà o diritto di pubblicità o privacy di qualsiasi persona e di Switchub; non violerà alcuna legge o regolamento; non sarà diffamatorio o calunnioso commerciale; non sarà osceno o tratterrà materiale pedopornografico; non tratterà lo sviluppo, la progettazione, la fabbricazione o la produzione di missili o armi nucleari, chimiche o biologiche non tratterà materiale legato ad attività terroristiche non includerà informazioni incomplete, false o imprecise sull’utente o su qualsiasi altro individuo; e non conterrà virus o altre routine di programmazione del computer intese a danneggiare, interferire in modo dannoso, intercettare di nascosto o espropriare qualsiasi sistema, dato o informazione personale.
È l’unico responsabile per I Contenuti che pubblica su o attraverso uno dei qualsiasi Servizi e di qualsiasi materiale o informazione che trasmetterà agli altri utenti. Switchub non approva e non ha alcun controllo sui Contenuti. I Contenuti non sono necessariamente rivisti dagli amministratori di Switchub prima di essere divulgati e non riflette necessariamente le opinioni o i criteri di Switchub stessa. Switchub non fornisce alcuna garanzia, espressa o implicita, sui Contenuti o sull’accuratezza e l’affidabilità degli stessi o di qualsiasi materiale o informazione che venga trasmessa dall’utente agli altri utenti.
L’utente non può inserire, modificare, distribuire o riprodurre in qualsiasi modo materiale protetto da copyright o trademark o altre informazioni proprietarie appartenenti ad altri senza aver ottenuto il preventivo consenso scritto del proprietario di tali diritti.
L’utente è l’unico responsabile delle informazioni personali e dei contenuti che dichiara su Switchub.
Tali informazioni e contenuti possono essere trasferite a terze parti qualora Switchub ne individuerà il bisogno per la gestione dei Servizi e miglioria del Sito, gli utenti verranno comunque avvisati tramite i canali di comunicazione ufficiali, e verrà data possibilità di confermare o di recedere, qualora non ci sia accettazione dell’utente, Switchub non garantisce la continua funzionalità dei servizi forniti.
Tali informazioni e contenuti, se richieste e ordinati da Tribunali o Forze dell’Ordine, possono essere trasferite agli organi richiedenti.
Se desideri revocare il tuo consenso, riconosci e accetti che Switchub potrebbe non essere in grado di fornirti l’accesso al sito e ai servizi di Switchub.
Switchub avverte che non tratta dati personali sensibili, ogni sistema informatico utilizzato per le funzionalità e Servizi di Switchub sono dichiarati nella Cookie Policy e regolamentati nella Privacy Policy che l’utente è tenuto a leggere.
- L’utente riconosce che:
Switchub fornisce nel portale web servizi di vetrina personale, matchmaking, prenotazione professionista, database, messaggistica interna Sito, social media Sito, aggiornamento e formazione professionale. Gli utenti concordano sul fatto che Switchub non ha alcuna responsabilità per qualsiasi altro aspetto della fornitura dei servizi o dell’interazione tra gli utenti. Registrandosi e utilizzando i servizi di Switchub, l’utente accetta che le proprie informazioni e i propri contenuti divulgati nel portale web siano visibili a tutti i Membri di Switchub.
Il team di Switchub, il Titolare e Responsabile del trattamento dei dati non sono parte in alcuna controversia tra gli utenti e non hanno alcuna responsabilità per la visualizzazione delle informazioni, dei contenuti e di dichiarazioni che sono divulgate in forma visibile sul Sito e in forma privata tra gli utenti.
L’utente può, di volta in volta, includere caratteristiche e informazioni della propria professione, informazioni personali, informazioni terze, disponibilità per prestazioni di lavoro, richiesta di ingaggio, compenso per il lavoro, scrivere o ricevere recensioni (“feedback”) sulle prestazioni di lavoro e mappa della posizione dell’utente (NO GPS). L’utente può mostrare la propria posizione agli utenti che navigano sul Sito (NO GPS) e le proprie informazioni che desidera rendere visibile sul Sito eccetto il suo personale recapito telefonico e indirizzo di posta elettronica, Switchub eliminerà senza alcun preavviso i recapiti e invierà in seguito comunicazione scritta. L’utente che propone lavori è tenuto a fornire tutte le informazioni necessarie in cui deve essere eseguito il lavoro e le informazioni necessarie che rendono affidabile la proposta di lavoro. L’utente accetta espressamente che Switchub non ha alcuna responsabilità per la visualizzazione e accettazione di tutte le informazioni divulgate dall’utente, in ogni forma che sia privata o visibile, nel Sito.
Switchub permette di inserire la posizione dell’indirizzo del luogo a te favorevole (NO GPS), le date in calendario della propria disponibilità, il proprio onorario, informazioni personali e altri Contenuti da te forniti con l’obiettivo di rendere la tua persona visibile nel database per la ricerca del professionista e per utilizzare tutti i Servizi del portale Switchub. Al completamento di un progetto di lavoro, l’utente Azienda, deve accedere al Sito nella sessione Bookings e fare clic sul pulsante “Paga ora” per confermare l’effettivo pagamento che ha inoltrato, in tal modo permetterà a l’utente Professionista nella sessione My Bookings di poter controllare e fare clic sul pulsante “Pagamento ricevuto?” per poter confermare la ricezione del compenso. Con questa procedura si archivia il rapporto di lavoro dichiarando conclusa la comunicazione tra le due categorie di utenti.
Switchub non percepisce alcuna commissione o percentuale sugli importi dichiarati dagli utenti. Le transazioni economiche tra gli utenti avvengono direttamente tra loro e all’esterno del Sito con modalità e procedure da loro determinate.
4.Dichiarazione di non responsabilità
Switchub non garantisce ed esclude tutte le garanzie che il materiale e le informazioni, compreso il materiale di terze parti, sul sito Web siano accurate, complete o veritiere o che siano prive di virus o che non contenga alcun materiale diffamatorio, osceno o in qualunque modo illecito.
I profili creati e pubblicati dai Membri sul Sito possono contenere, informazione personali e di altro genere, link ad altri siti web e contenuti di terze parti, Switchub e il suo Team non sono responsabili per l’accuratezza del contenuto o delle opinioni espresse dai Membri e da ogni contenuto da essi divulgati.
In nessun caso Switchub e il suo Team saranno responsabile verso i propri utenti o verso soggetti terzi per eventuali perdite o danni (diretti o indiretti, compresa la perdita di profitti, perdita di opportunità o qualsiasi altra perdita) derivante da – o in qualsiasi modo connessa con – l’utilizzo del Sito o del suo contenuto, sia essa causata da negligenza, travisamento dei contenuti stessi, violazione di qualsiasi obbligo di legge o del contratto, malfunzionamento del Sito o altro.

The first category allows the employer, through the “booking” feature, to search and book the professional, by simply filling in the infobox window where you have to indicate the city, dates of the possible job and the task the system starts the first matching after clicking on “search”.
Personnel selection is automatic, after entering the necessary information, the search booking system proposes the most suitable professionals for your project based on the city, availability and task indicated by the professional in their account. In addition, if you want to optimize the selection of staff, the system has additional advanced search filters by indicating the compensation, soft and hard skills the employer will benefit from a detailed and selected list with suitable professionals for his work needs.
Finally, the platform features a “problem solving” section, which enables problem solving through sharing the experiences of community users.

1.GENERAL CONDITIONS
Please read this section carefully. By accessing the Switchub web portal (“Site”) you agree to the terms and conditions defined below.
These Terms of Agreement (“Agreement”) set forth the legally binding terms relating to your use of Switchub’s services (“Services”). By using the Services, you agree to be bound by this Agreement as a registered user. The term “user” or “users” refers to both existing modes of registration in the Switchub portal which are two categories of accounts; Company (Company) and Professional, both defined (“Members”). Each may consider himself/herself authorized to use the Services once he/she has committed to abide by all the rules of this agreement.
The Switchub Platform provides an online place (“Hub”) for users to search and book a Professional, offer a job engagement, offer their professionalism, post content describing their profession and job-related content, and increase and improve their professional skills. The user who searches, books and offers work is the Company/Company while the user who offers their professionalism is the Professional. Both categories publish content describing their profession and job-related content. You must register an account to use the features of the Switchub Platform and keep your account information accurate. As a provider of the Switchub Platform, Switchub does not own, control, offer, or manage any proposed employment engagements. Switchub is not a party to contracts entered into directly between Company (“Company”) and the Professional nor is it a temp agency or vendor of the Services offered. Switchub does not act as an agent for any of the registered users. The use of Switchub’s Services are free of charge.
Before using the Site, you must read the entire Agreement, Site policies, and all related information. You must read and agree to the Terms and Conditions in order to use the Services. By accepting this User Agreement while accessing our Site, you agree that this Agreement applies whenever you use the Site or when you use the tools we provide to interact with the Site.
This Agreement will remain in full force and effect for as long as you use the Service and join the Site itself. You may terminate your membership at any time, for any reason, by following the instructions on the Site. Switchub has the right to terminate any membership at any time, without notice, temporarily or permanently, if the user uses the services illegally or does not comply with the terms and conditions of this agreement. Communication and related motivation will be sent via email from the moment the limitation takes effect.
Switchub reserves the right, at its sole discretion, to make changes to any part of the Site. Due to its policy of updating and improving the Site, Switchub may wish to modify these Terms and Conditions (including those relating to the use of the Services and Content). The contractual changes arranged by the Switchub will be communicated to users through publication on the portal or by email address and the user will have 30 days to withdraw free of charge, without any penalty and without specifying the reason; however, if the 30 days elapse without exercising the withdrawal, the new contractual clause/change will be deemed accepted.
Switchub is a project with an online platform in beta version, for this reason the functions and access to the services may cease, temporarily or definitively in the event that there are:
– sudden technical, IT and administrative problems,
– platform transfers to other domains or applications for updates or improvements,
– updates of the IT technical system,
– absence of user activity or absence of registrations,
– economic difficulties concerning the IT and administrative technical management.
Users will be informed at least 15 days in advance, via email or Switchub official channels if the termination of services is foreseeable, within 48 hours after the event if the termination is unforeseen.
2. Services
- The Services are provided as is and as available to the Switchub cannot guarantee and does not promise any specific results from the use of the Services themselves.
- The Services are for the personal use of the registered user of the Site and may not be used in connection with any commercial purpose except those specifically endorsed or approved by Switchub. Illegal and/or unauthorized uses of the Services, including the collection of users’ usernames and/or e-mail addresses and/or personal data by electronic or other means for the purpose of sending unsolicited e-mail, are

- Switchub reserves the right to cancel or temporarily block, without notice, the user who has used the services of the Site illegally. The user will receive information, via email, on the reasons that led to any blocking of access.
- The services can be expanded or modified according to the need that identifies Switchub.
- In order to use the Switchub services, an account must be registered using a personal email and password, the information will be used to restore the password itself and to allow accessibility and use of the services on the web portal.
- The email used for registration will also allow you to receive official Switchub information. The user’s email will not be transferred to third parties for advertising or other activities that do not concern the activities and services of Switchub.
There are two categories of membership in the Site, as described below. Switchub reserves the right to expand or change these categories at its sole discretion. By accessing Switchub all users agree to these terms; however, users will be notified, and will be given the opportunity to opt out within 30 days otherwise the changes will be deemed accepted.
- Company registration (I’m a company)
Subject to acceptance of this document and the general terms set forth herein, companies are granted access to the information contained in our database. Each company must ensure its good faith and use the Site as such. Companies should use the information in the Site database for the sole purpose of considering possible employment or collaboration with our users. Switchub makes no warranties of truthfulness with respect to the information provided by users on our database and therefore we cannot assume any responsibility for its use or non-use. All terms, conditions, warranties and representations, express or implied, including conditions of merchantability or fitness manifested by users are their own responsibility. Switchub cannot, under any circumstances, be held liable for any indirect, special or consequential damages arising in any way from Professional users.
- Professional registration (I’m a professionalist)
Each user has the right to enter, in a prescribed form and in an autonomous form, his/her profile information (“Information”) on a web page of our portal Switchub (“Site”). The user has the right to use the services of Switchub, which are issued free of charge and available 24 hours a day. In the event that this is not possible, any problems will in any case be resolved as soon as reasonably possible.
With your explicit consent, for the sessions you determine, we will automatically make the data provided available to other users of our Site, including Company users.
The data that users make visible in the portal must be of a suitable nature for the sole purpose required for the use of the services. Switchub does not require to disclose sensitive data in the portal in public or private form such as: racial and ethnic origin ; religious, philosophical or other beliefs; political opinions; membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade union nature; state of health, sex life, sexual orientation. Any type of disclosure of sensitive data is the sole responsibility of the user, Switchub invites users to immediately report any irregularities of the case.
Switchub is unable to verify or provide any assurance regarding the nature or duration of any work or appointment offered as a result of using the Service.
It remains the sole responsibility of the user to ensure that anything offered is acceptable or not. All electronic correspondence sent to the registered user’s e-mail address on the Service is intended for that person alone, as the sole recipient. Your account is at risk if you forward emails that contain relevant links related to your individual profile. Switchub cannot, under any circumstances, be held liable for any indirect, special or consequential damages arising in any way from users Company.
3. Contents
No registered user (business or professional) is permitted to upload, distribute, or disseminate to the Site any information that is libelous, defamatory, obscene, pornographic, offensive, that, in any other way, violates any law or the rights of any other person or entity, or that contains a solicitation of funds, goods and services, or advertising. Switchub does not intend to take any responsibility if these rules are not followed. The user is personally responsible for the content disclosed on the site. Switchub, in its sole discretion, reserves the right to reject, refuse to post, or remove any post, including private messages, written by any user or to restrict, suspend, or cancel access to all or precise portions of the service at any time, for any or no specific reason, with or without notification, but certainly without assuming any liability.
By using the Services, you warrant that all information recorded is true and accurate. It is always the user’s responsibility to ensure the maintenance and care of the same, an age over 18, and consistent and lawful use of the Service. “Minimum Age” means 16 years of age. However, if the law requires that you must be of an older age in order for Switchub to legally provide the Services without parental consent (including the use of your personal information), then the Minimum Age will be as determined by law.
When a user registers on the Site, they are asked to choose a password. They are solely responsible for any use of their password and account. Users agree not to use third-party accounts, usernames, and passwords and not to disclose their login information to third parties. You also agree to notify Switchub immediately of any suspected unauthorized use of your account or access to your password. The Services are intended for personal use only and may not be used for commercial use unless previously approved by Switchub. Illegal and/or unauthorized uses of the Services, including attempting to collect users’ usernames and passwords by electronic or other means to send unsolicited email is prohibited.
Switchub does not claim any ownership rights to any text, files, images, photos, videos, sounds, musical works, works of authorship, or other materials and user information (“Content”) that are posted on the site. After posting Content, you continue to retain all ownership rights in the Content and continue to have the right to use the Content in any way you deem lawful. By posting Content on or through the Site, you grant Switchub permission to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Site or on Switchub-related promotional outreach channels, we will not change the meaning of your expression. You are free to license your Content to anyone else in addition to Switchub. Switchub is not required to pay for the use of content on the Site. Content on the Site may include general information on legal, financial, health and other matters. The information disclosed by the user is their personal responsibility, the truthfulness and suitability of it is not the responsibility of Switchub it is the user’s obligation to ascertain before any action and acceptance of the Content.
We provide unmonitored access to Third Party Content, including user feedback and articles with original Content and opinions (or links to such Third Party Content). We act only as a portal and have no liability based on or related to third-party content on the Site, arising under copyright or other intellectual property laws, defamation, privacy. The Site may contain links to other third-party
Web sites. We do not control the Web sites we link to from the Site. We do not endorse the content, products, services, practices, policies, or performance of Web sites we link to from the Site. Use of third-party content, links to thirdparty content, and/or Web sites is at your own risk.
You can delete your account at any time by accessing your profile settings. Deletion will cause the permanent removal of all data you have provided, including data generated by your use of the site. The process is not reversible.
• The user warrants that:
is the owner of the Content posted on or through the Services or, otherwise, to have the right to grant the license to use set forth in this section. It does not cooperate with or own a web platform that has the same purposes and/or services offered by Switchub, if it is established that Switchub is being used to reproduce copies of the services present or to cause harm to the portal itself and the registered users, any unlawful conduct and dispute of this aspect will be regulated in legal ways.
The posting of Content on or through the Site does not violate the privacy rights, publicity rights, copyrights, contract rights, or other rights of any person. You agree to pay for all royalties, fees, and other monies owed to any other person by reason of any content posted by you through the Services.
Switchub assumes no responsibility for Content posted by users. Nonetheless, Switchub may remove any Content that in Switchub’s sole judgment violates this Agreement or which may be offensive, illegal or violate the rights, harm or threaten the safety of any person or that of the site. Switchub has no obligation to edit or remove inappropriate Content, and no responsibility for the conduct of the user submitting such Content.
Except for Content posted by you, you yourself may not copy, modify, translate, publish, transmit, distribute, perform, or sell any other Content displayed or posted through the Switchub Services.
• The user states that:
Will not infringe or misappropriate any copyright, patent, trademark, trade secret or other intellectual property right or right of publicity or privacy of any person or Switchub; will not violate any law or regulation; will not be defamatory or libelous commercial; will not be obscene or deal in child pornography will not deal with the development, design, manufacture, or production of missiles or nuclear, chemical, or biological weapons will not deal with material related to terrorist activities will not include incomplete, false, or inaccurate information about the user or any other individual; and will not contain viruses or other computer programming routines intended to damage, maliciously interfere with, surreptitiously intercept, or expropriate any system, data, or personal information. You are solely responsible for The Content you post on or through any of the Services and for any material or information you transmit to other users. Switchub does not endorse and has no control over the Content. The Content is not necessarily reviewed by Switchub administrators before being disseminated and does not necessarily reflect the opinions or criteria of Switchub itself. Switchub makes no warranties, expressed or implied, about the content or about the accuracy and reliability of it or any material or information that is transmitted by you to other users. You may not include, modify, distribute or reproduce in any way copyrighted or trademarked material or other proprietary information belonging to others without obtaining the prior written consent of the owner of such rights. You are solely responsible for the personal information and content you state on Switchub. Such information and content may be transferred to third parties should Switchub identify the need for it for the management of the Services and improvement of the Site, users will still be notified through official communication channels, and will be given the opportunity to confirm or withdraw, if there is no user acceptance, Switchub does not guarantee the continued functionality of the services provided. Such information and content, if requested and
ordered by courts or law enforcement agencies, may be transferred to the requesting agencies. If you wish to withdraw your consent, you acknowledge and agree that Switchub may not be able to provide you with access to the Switchub site and services.
Switchub warns that it does not process sensitive personal data, any computer systems used for Switchub’s features and Services are stated in the Cookie Policy and regulated in the Privacy Policy which you are required to read.
• The user acknowledges that:
Switchub provides in the web portal personal showcase services, matchmaking, professional booking, database, internal Site messaging, social media Site, updating and professional training. Users agree that Switchub has no responsibility for any other aspect of service provision or interaction between users. By registering and using Switchub’s services, you agree that your information and content disclosed in the web portal is visible to all Switchub Members.
The Switchub team, Data Controller and Data Processor are not parties to any dispute between users and have no responsibility for the display of information, content and statements that are disclosed in visible form on the Site and privately between users.
You may, from time to time, include characteristics and information of your profession, personal information, third party information, availability for job performance, request for engagement, compensation for work, write or receive reviews (“feedback”) of your job performance, and map your location (NO GPS). User may show his/her location to users browsing the Site and his/her own information that he/she wishes to make visible on the Site except his/her personal telephone number and email address, Switchub will remove without notice the contact details and send written notice thereafter. The user proposing work is required to provide all necessary information where the work is to be performed and the necessary information that makes the proposed work reliable. The user expressly agrees that Switchub has no responsibility for the display and acceptance of all information disclosed by the user, in any form that is private or visible, on the Site.
Switchub allows you to enter the location of the address of the place favorable to you, the calendar dates of your availability, your fee, personal information, and other Content provided by you with the goal of making your person visible in the database for practitioner search and to use all the Services of the Switchub portal. This data may be shared as part of the facilitation of the Professional Search Services and each user expressly consents to such collection and sharing as part of this agreement.
Upon completion of a work project, the Company user, must log into the Site in the Bookings session and click on the “Pay Now” button to confirm the actual payment they have submitted, thus allowing the Professional user in the My Bookings session to be able to check and click on the “Payment Received?” button to be able to confirm receipt of compensation. This procedure will close the working relationship by declaring the communication between the two categories of users to be finished.
Switchub does not receive any commission or percentage on the amounts declared by users. Economic transactions between users take place directly between them and outside the Site in a manner and procedure determined by them.
4. Disclaimer statement
Switchub makes no warranty and disclaims all warranties that the material and information, including third-party material, on the Web site is accurate, complete, or truthful or that it is free of viruses or contains no defamatory, obscene, or in any way unlawful material.
Profiles created and posted by Members on the Site may contain, personal and other information, links to other websites and third-party content, Switchub and its Team are not responsible for the accuracy of the content or opinions expressed by Members and any content they disclose.
In no event shall Switchub and its Team be liable to its users or to any third party for any loss or damage (direct or indirect, including loss of profits, loss of opportunity, or any other loss) arising out of – or in any way connected with – the use of the Site or its content, whether caused by negligence, misrepresentation of the content itself, breach of any legal or contractual obligation, malfunction of the Site, or otherwise.
5.Allowance
You agree to indemnify and hold Switchub and its Team harmless from-and against – all costs, claims, demands, expenses and liabilities suffered or incurred arising directly or indirectly, if at all, in connection with access and/or use of the site by the user himself/herself and/or any other person or entity that was able to access the site using the password of the user in question.
